1.2. Byzed.com is designed and published to promote Zulfikar Fidanci’s personal art designs to the companies that are interested to purchase this art designs and materials.

1.3. Byzed.com contains the followings: Zulfikar Fidanci’s historical designs, historical contact information, some referral presentations of his designs, cultural and commercial private packaging designs.

2. USAGE OF THE WEB SITE

2.1. Visitor only can have purpose of viewing Zulfikar Fidanci’s personal information, references, collection of his designs and Zulfikar Fidanci’s personal and professional talent.

2.2. Visitor accepts and understands that any art material or product or any part of any art material or product that reside under “References” page are copyright of Zulfikar Fidanci and they cannot be downloaded, printed, archived or used without knowledge of Zulfikar Fidanci.

2.3. Visitor accepts and understands that any art material or product or any part of any art material or product that reside under “Collection” page are copyright of Zulfikar Fidanci and they cannot be downloaded, printed, archived or used without knowledge of Zulfikar Fidanci.

2.4. Visitor who wants to access “Collection” page should fill out the form that can be found in “Contact” page and request username and password. Visitor who requests the username and password should receive an e-mail which contains username and password to the e-mail account which is provided in the request form in 3 days. These username and password can be used by the person who requested them or the authorized personnel of the company which is provided in request form by visitor. They cannot be used by 3rd party.

2.5. Zulfikar Fidanci has rights to cancel the access to “Collection” page of any visitor if visitor don’t show any written interest. In this case, visitor can fill out the form and request the gain access to “collection” page once again.

2.6. Visitor accepts and confirms that the provided information in the request form is correct.

3. PURCHASING

3.1. Visitor can purchase one or more packaging designs in “Collection” page. Each packaging design item is priced as “design price” next to each item. Each packaging design item is priced as presented and shown in “Collection” page.

3.2. Visitor should fill out the form in the “Contact” page and provide “code number”, “design price” (including currency) and “packaging information” (canister packaging and/or bottle size within weight in grams) of the item into “Description” field in the form in order to purchase any item. If there is more than one item, information can be provided for each item separately in the form.

3.3. Visitor deposits or transfers the “design price” into one of bank account of Zulfikar Fidanci in order to be “owner” of the art material or product. Visitor emails or faxes the receipt of the money transfer and become “owner” of the art material or product. When the purchase is completed, Zulfikar Fidanci will remove that product or art material from his website immediately. Bank information will be provided as an e-mail upon visitor’s request. After the purchase, visitor becomes a buyer and buyer should not include any credit card information into any e-mail messages.

3.4. Any packaging information or company logo that requested to be performed on purchased product or art material or packaging design by buyer is not included the price, these will be done only once by Zulfikar Fidanci after purchase. Zulfikar Fidanci will perform those changes without damaging the originality of the product, packaging design or art material.

3.5. Any other additional application which is requested by buyer will be additional cost and will be priced according to type of the application (e.g. Riviera, Prina or 3 lt canister or 2lt plastic bottle, etc.). Payment for additional application (s) will be sent or transferred one of the Zulfikar Fidanci’s bank account within full amount after the work is done. Receipt of the deposit or transfer should be faxed or e-mailed to Zulfikar Fidanci. Those additional applications are priced in byzed.com under “Price List of Additional applications”.

3.6. Visitor has right to make any changes on the purchased products, art materials or packaging designs. In this case, purchased products, art materials or packaging designs will be delivered as pointed in section 4.2 in this document.

4. DELIVERY OF THE PURCHASED ITEMS

4.1. Purchased items will be delivered as shown in byzed.com or will be delivered within brand and product information of the buyer.

4.2. Delivery will be performed in below methods:

4.2.1. Delivery can be performed on internet using by secure server (e.g. FTP server or and kind of shared environment), once the purchased item(s) is uploaded, buyer will receive a link to download it.

4.2.2. Delivery can be performed by sending purchased item(s) via mail or courier as either CD-ROM or DVD-ROM.

In both methods, purchased item will be saved in a format using by the computer program that Zulfikar Fidanci uses in his computer. Buyer will be informed about those computer programs, formats and version of the computer programs.

4.3. Purchased item(s) will be archived by Zulfikar Fidanci for a year and buyer(s) will be able to retrieve those items as “delivered when they were purchased or modified last time” by Zulfikar Fidanci without any cost. Shipping will be paid by buyers.

5. RIGHT AND RESPONSIBLITIES

5.1. All the products that belong to Zulfikar Fidanci even though they are not published on internet are copyright of Zulfikar Fidanci. Purchased or delivered products are copyright of buyers.

5.2. Buyer(s) have right to publish own purchased product(s) in any written or visual media or in advertisements or internet. Buyer(s) have rights to make positive or negative comments, reviews or reference about byzed.com, Zulfikar Fidanci and products.

5.3. Zulfikar Fidanci has right to publish any purchased product(s) in any written or visual media or in advertisements or internet. Zulfikar Fidanci has rights to make positive or negative comments, reviews or reference about Buyer(s).

5.4. Under no circumstances, Zulfikar Fidanci and Buyer and Visitor cannot make any comments or give reference that break any section or any rules which are defined and explained in this agreement.

5.5. Zulfikar Fidanci has right to shutdown byzed.com or any other website that he owns in anytime without giving out any time limit. Zulfikar Fidanci has right to stop his services any time without giving out any warning or time limit. Zulfikar Sabanci has right to stop any purchases before purchase is completed or purchase back any product that paid and received by buyer.

5.6. Zulfikar Fidanci has right to decommission or change this agreement without any warning.

5.7. Visitor has right to cancel the purchase and get their money back after all the bank expenses taken out from paid price if the purchased item has not been taken off from “Collection” page or if there was no additional change has been made on the product.

6. LEGAL RESPONSIBILITIES

6.1. Visitor accepts this agreement by continuing to browse and use this website you are agreeing to comply with and be bound by the terms and conditions of this agreement.

6.2. This web site and its content are owned by Zulfikar Fidanci are protected by City of Izmir Court of Republic of Turkey copyright laws and international treaty provisions. All content, trademarks, services marks, trade names, logos, and icons are proprietary to Zulfikar Fidanci.
